Q: Am I prevented from taking disciplinary action against an employee who has a filed a complaint or employment claim?

A: Employees who file charges or lawsuits while continuing in employment are not immune from disciplinary action, but employers should take great care that any discipline is consistent with discipline imposed against employees who have not filed complaints. Disciplinary action includes suspension when it adversely affects the employee, even if the suspension is later rescinded. Not only should employers make certain that disciplinary action is consistent with actions taken for similar infractions in the past, employers must be willing to take the same action in the future.
